2. DATA SOURCE (HOW DO WE OBTAIN IT?)

The personal data we process at adsCalling may come from two distinct sources:

  1. Direct Collection: When the user registers directly in our own promotions, raffles, or web forms.
  2. Indirect Collection (Third Parties): When data is communicated to us by collaborating companies (Editors or "Publishers", such as Nexa Digital Solutions LLC) that have previously obtained the user's express and informed consent for the transfer of their data to multi-sector marketing companies. In this case, adsCalling acts as an independent Data Controller from the moment it receives the data.

3. PURPOSES AND LEGAL BASIS

We process your data for the following purposes and legal basis:

Profiling (Scoring): Segmenting the user by age, geographical area, or interests to personalize advertising. Legitimate Interest and Consent to receive personalized advertising.
Transfer to Advertisers: Communicating data to final companies (Advertisers) in the indicated sectors. Specific Consent for transfer to third parties.

4. ACTIVITY SECTORS (ADVERTISERS)

adsCalling may send its own advertising or communicate your data to third-party companies in the following sectors, provided the user has consented to receive multi-sector information:

  • Telecommunications, Technology, and Internet.
  • Energy (Electricity, Gas, Solar) and Utilities (Water).
  • Financial, Insurance, and Legal.
  • Real Estate, Alarms, and Home.
  • Education, Publishing, and Employment.
  • NGOs and Humanitarian Aid.
  • Automotive and Transport.
  • Health, Wellness, and FMCG.

5. RECIPIENTS AND TRANSFERS

Your data may be communicated to the following categories of recipients:

  1. Final Advertisers: Companies in the sectors indicated in the previous section to contact you directly with their offers.
  2. Data Processors: Technology service providers (Hosting, email/SMS sending platforms, Call Centers) acting under our instructions and confidentiality agreement.
  3. Authorities: Judges, Courts, and Security Forces if there is a legal obligation.

We do not transfer data internationally outside the European Economic Area (EEA) without appropriate guarantees (such as signing Standard Contractual Clauses approved by the European Commission).

6. RETENTION PERIODS

  • Data for advertising purposes: Will be kept as long as the data subject does not request its deletion or revoke their consent.
  • Blocked data: Once the processing is finished or unsubscription is requested, the data will be kept duly blocked for 5 years to address possible legal responsibilities before the Data Protection Agency.

7. USER RIGHTS

You may exercise your rights at any time and free of charge by writing to dpo@adscalling.com, attaching a copy of your ID or means proving your identity:

  • Access: Know what data we have about you and its source.
  • Rectification: Correct erroneous or inaccurate data.
  • Erasure (Right to be Forgotten): Request that we delete your data from our files.
  • Opposition: Object to receiving further advertising. By doing so, your data will be moved to an internal Robinson List of advertising exclusion to avoid contacting you again.
  • Limitation and Portability: Request the limitation of processing or receive your data in a structured format.

8. SECURITY

adsCalling applies technical and organizational security measures (encryption, access control, firewalls) compliant with the General Data Protection Regulation to protect the confidentiality, integrity, and availability of information.

9. MODIFICATIONS

adsCalling reserves the right to modify this policy to adapt it to legislative or jurisprudential developments. The validity of the policy coincides with its publication on this website.
